1. Introduction and Scope
These Terms of Service (hereinafter "ToS" or "Terms") constitute a legally binding agreement between you (hereinafter "User") and DiscordInvites, a platform operated by its founders (hereinafter "DiscordInvites", "we" or "the Platform"), accessible at discordinvites.net. By accessing the Platform, creating an account, submitting content, or using any service offered, you acknowledge that you have read, understood, and unconditionally agreed to these Terms in their entirety, as well as our Privacy Policy, which forms an integral part hereof. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE PLATFORM.
2. Definitions
For the purposes of these Terms, the following terms have the meanings assigned to them below: "Platform": the website discordinvites.net, its subdomains, APIs, mobile applications, and any associated services. "User": any individual or legal entity accessing the Platform, with or without a registered account. "User Content": any text, image, description, review, data, or information submitted by a User on the Platform. "Server": a Discord server listed on the Platform by its owner. "DCoins": virtual currency internal to the Platform, with no legal monetary value. "Premium Services": advanced features accessible for a fee. "Illegal Content": any content contrary to applicable laws, these Terms, or Discord Inc.'s Terms of Service.
3. Acceptance of Terms
Use of the Platform constitutes full and unreserved acceptance of these Terms. This acceptance is evidenced by: - Connecting via Discord OAuth2 - Submitting any form or content - Simply browsing the Platform beyond the home page The User acknowledges that these Terms prevail over any prior verbal or written agreement. Any use of the Platform for commercial purposes without prior written consent from DiscordInvites is strictly prohibited.
4. Eligibility Requirements
To use the Platform, you must: - Be at least 13 years of age, or the minimum age required by the laws of your country of residence if higher than 13 - Hold an active Discord account in good standing with Discord Inc.'s Terms of Service - Have full legal capacity to enter into a binding contract - Not have previously been banned from the Platform Minors must obtain consent from a legal guardian. DiscordInvites reserves the right to request proof of age or identity at any time.
5. Account and Responsibility
Authentication is performed exclusively via Discord OAuth2. The User is solely and fully responsible for: - All activity performed under their account, whether authorized or not - The security and confidentiality of their Discord credentials - The compliance of their listed servers with these Terms and Discord's Terms - Any consequences arising from unauthorized access to their account In the event of unauthorized use of your account, you must immediately notify DiscordInvites. We disclaim all liability for losses resulting from unauthorized access not reported within 48 hours. A user may only hold one active account. Creating multiple accounts to circumvent a ban constitutes a serious violation of these Terms.
6. Rules of Conduct
The User agrees to use the Platform in a fair, lawful manner consistent with its intended purpose. The following are expressly prohibited: - Publishing illegal, hateful, discriminatory, obscene, defamatory, or human dignity-violating content - Listing servers that promote illegal activities (fraud, trafficking, etc.) - Harassing, intimidating, or endangering other Users - Impersonating any individual, legal entity, or brand - Publishing false information or misleading descriptions - Any behavior intended to harm the integrity or reputation of the Platform
7. Strictly Prohibited Activities
The following are formally prohibited, subject to immediate termination and legal action: - Using bots, scripts, or any automated tool to generate artificial votes, bumps, or interactions - Any attempt to manipulate ranking algorithms or exploit technical vulnerabilities - Circumventing security systems, access restrictions, or bans - Unauthorized collection of other Users' data (scraping, harvesting) - Reselling, renting, or transferring DCoins or Premium benefits for consideration - Any attempt to reverse engineer, decompile, or extract the Platform's source code - Unauthorized access to DiscordInvites' computer systems, databases, or private APIs - Distributing malware, viruses, Trojan horses, or any harmful code via the Platform - Any activity constituting a violation of intellectual property rights Any detected violation will result in immediate account suspension without notice or refund, and may be reported to the competent authorities.
8. Automated Access and API
Any automated access to the Platform (bots, crawlers, scrapers, scripts) requires prior written authorization from DiscordInvites. Without authorization: - Automated access constitutes a violation of applicable database rights - DiscordInvites reserves the right to technically block any unauthorized access - Any substantial or repeated extraction of data may result in civil and criminal proceedings Use of DiscordInvites' public API is subject to rate limits. Any attempt to circumvent these limits constitutes unauthorized computer access.
9. User Content
The User retains intellectual property ownership of their User Content. By publishing content on the Platform, they grant DiscordInvites a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, reproduce, modify, adapt, distribute, and display such content in the context of operating the Platform. The User warrants that their content: - Does not infringe any third-party intellectual property rights - Contains no illegal elements or elements contrary to these Terms - Is accurate and not misleading DiscordInvites reserves the right to moderate, modify, or remove any content without notice or justification, at its sole discretion. No content removal gives rise to compensation. NSFW content must be mandatorily flagged as such. Failure to comply results in immediate removal of the relevant server.
10. Intellectual Property
The Platform, its source code, design, graphics, logo, trademarks, databases, and all original content are the exclusive property of DiscordInvites and are protected by copyright, trademark law, database rights, and all other applicable intellectual property rights. It is strictly prohibited to: - Reproduce, copy, or imitate the Platform or its elements without written authorization - Use DiscordInvites' trademarks or logos for commercial purposes - Create derivative works based on the Platform's code or design - Claim affiliation with DiscordInvites without express authorization Any violation of these rights constitutes infringement subject to civil and criminal proceedings.
11. Premium Services and Payments
Premium Services are offered via Stripe, a third-party payment processor. By subscribing to a Premium plan, the User: - Expressly authorizes recurring charges at the amount and frequency of the subscribed plan - Acknowledges that Premium access is activated immediately upon payment confirmation - Agrees that monthly subscriptions are refundable within 7 days of the first payment only - Acknowledges that annual subscriptions are non-refundable once activated - Agrees that access continues until the end of the billed period upon cancellation DiscordInvites reserves the right to: - Modify pricing with 30 days' notice via Platform notification - Suspend Premium access in the event of fraudulent payment or chargeback - Pursue recovery of any amount due in the event of abusive chargeback Any unjustified chargeback will result in permanent account suspension and may be subject to a recovery action including processing fees.
12. DCoins — Virtual Currency
DCoins are a virtual currency internal to the Platform. The User expressly acknowledges that: - DCoins have no legal monetary value and cannot be exchanged for real currency - DCoins are non-refundable and non-transferable between accounts - DiscordInvites reserves the right to modify the value, operation, or eliminate DCoins at any time without compensation - Upon account termination for cause, DCoins are permanently forfeited without right to compensation - DCoins obtained fraudulently will be cancelled and may result in legal action
13. Termination and Sanctions
DiscordInvites reserves the right to suspend or terminate any account, with or without notice, for the following reasons (non-exhaustive list): - Violation of these Terms or the Privacy Policy - Fraudulent activity, manipulation, or abuse of the Platform - Repeated and substantiated reports from other Users - Order from a competent judicial or administrative authority - Conduct harmful to the reputation or integrity of the Platform Upon termination for cause: - No refund will be issued, regardless of the remaining subscription period - Accumulated DCoins and benefits are permanently forfeited - Access to the Platform may be permanently blocked The User may delete their account at any time from their dashboard. Deletion results in permanent erasure of data in accordance with our Privacy Policy, subject to legal retention obligations.
14. Disclaimer and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. DiscordInvites expressly disclaims all liability for: - The content, conduct, or activities of listed Discord servers - Any data loss, service interruption, or Platform unavailability - Any direct, indirect, incidental, special, or consequential damages arising from use or inability to use the Platform - Discord Inc.'s decisions affecting your account or servers - Acts of third parties, hacking, or unauthorized access despite security measures in place - The accuracy, completeness, or reliability of information published by Users To the extent permitted by applicable law, DiscordInvites' total liability shall not exceed the amount actually paid by the User for Premium Services during the three (3) months preceding the event giving rise to the claim.
15. Indemnification
The User agrees to defend, indemnify, and hold harmless DiscordInvites, its founders, administrators, employees, and service providers from any claim, demand, damage, loss, cost, or expense (including attorneys' fees) arising from: - Their violation of these Terms - Their User Content - Their infringement of any third-party rights, including intellectual property rights - Their unlawful or abusive use of the Platform - Any dispute between the User and another User or third party This indemnification obligation survives account termination.
16. Copyright Infringement — DMCA / Takedown
If you believe that content published on the Platform infringes your intellectual property rights, you may submit a takedown notification via our contact page, providing: - Your full identity and contact details - A precise description of the protected work - The exact URL or location of the disputed content - A sworn statement attesting to your good faith - Your electronic or handwritten signature Any abusive or bad-faith notification engages the liability of its author. DiscordInvites reserves the right to forward received notifications to the relevant Users.
17. Dispute Resolution
In the event of a dispute relating to these Terms or the use of the Platform, the parties agree to attempt to resolve the dispute amicably within thirty (30) days from the notification of the dispute by the most diligent party. Failing amicable resolution, and unless otherwise required by applicable consumer protection law, any dispute shall be submitted to the exclusive jurisdiction of the competent courts of DiscordInvites' registered seat. Users residing in the European Union retain the right to bring proceedings before the courts of their habitual residence and to use the European Commission's Online Dispute Resolution platform.
18. Governing Law
These Terms are governed by French law and, where applicable, European Union law, including: - Regulation (EU) 2016/679 on personal data protection (GDPR) - Directive (EU) 2019/770 on digital content supply contracts - The French Data Protection Act (Loi Informatique et Libertés) - The French Intellectual Property Code - The Digital Services Act (DSA) — Regulation (EU) 2022/2065 If any provision of these Terms is found contrary to mandatory law applicable to a User, only that provision shall be disapplied, the remainder of the Terms remaining fully applicable.
19. Force Majeure
DiscordInvites shall not be held liable for any failure to meet its contractual obligations resulting from a force majeure event, including but not limited to: - Natural disasters, pandemics, or acts of war - Cyberattacks or major security incidents beyond our control - Failures of third-party infrastructure (hosting, DNS, CDN) - Government or regulatory decisions affecting our services - Interruption of Discord Inc. services on which the Platform depends DiscordInvites undertakes to notify the User as soon as possible and to take all reasonable measures to remedy the situation.
20. Severability
If any provision of these Terms is declared null, invalid, or unenforceable by a competent court, that provision shall be deemed unwritten and the remainder of the Terms shall remain fully valid and binding between the parties. The parties agree, in such case, to negotiate in good faith a valid replacement provision that most closely reflects the parties' intent as expressed in the invalidated clause.
21. Entire Agreement
These Terms, together with the Privacy Policy and any specific conditions applicable to Premium Services, constitute the entire agreement between the User and DiscordInvites regarding the use of the Platform. They supersede and replace all prior agreements, negotiations, representations, or undertakings, whether oral or written, relating to the same subject matter. No verbal statement by any DiscordInvites representative shall modify or supplement these Terms.
22. No Waiver
DiscordInvites' failure to exercise or delay in exercising any right or remedy provided under these Terms does not constitute a waiver of that right or remedy. Any waiver of a right applies only to the specific instance concerned and cannot be interpreted as a general or permanent waiver of that right. DiscordInvites' tolerance of any breach of these Terms creates no vested right for the User and may not be invoked as a precedent.
23. Changes to These Terms
DiscordInvites reserves the right to modify these Terms at any time. In the event of a material change, we will notify Users via Platform notification at least 15 days before the new terms take effect. Continued use of the Platform after the effective date of the new Terms constitutes acceptance thereof. If you refuse the new Terms, you must cease using the Platform before they take effect. The current version is always accessible at discordinvites.net/tos. The date of the last update is indicated at the top of the document.
